TERMS AND CONDITIONS

General terms and conditions of sale shall apply to products and services marketed by THEOTOP SRL via online shop www.theotop.ro to the Buyer and may be amended only with the express written consent of both parties.

In this document, the following terms shall mean:

CUSTOMER: natural person, legal person, company or other legal entity that has or obtains access to the Site by any means of communication provided by the THEOTOP SRL (electronic, phone, etc.) or based on existing usage agreement between THEOTOP SRL and this and that requires the creation and use of an ACCOUNT;

ORDER: an electronic document that comes as a form of communication between seller and buyer that the Seller agrees to deliver products and/or services, and the Buyer agrees to receive these products and/or services and make their payment;

ACCOUNT: section of the site consists of an e-mail and password that allows the transmission shopper Order and contains information about Customer/Buyer and the Buyer history (orders, invoices, warranties goods, etc.);

CONTRACT: order confirmed by the Seller by issuing tax invoice. Conclusion of contract occurs when issuing the invoice and not ordering or issuing the receipt of this order;

BUYER: natural person, legal person, company or other legal entity which issues an Order;

DOCUMENT: sections TERMS AND CONDITIONS, ORDERS and PRIVACY POLICY of the Site;

INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS: all intangible rights such as know-how, copyright and rights in the nature of copyright, database rights, design rights, model rights, patents, trademarks and name registrations areas for any of the above;

PRODUCTS AND SERVICES: every turnkey project, equipment, material and/or part thereof or service, including documents and services mentioned in the Order or otherwise relating thereto which will be provided by the Seller to the Buyer;

SITE: domain and its subdomains of www.theotop.ro;

SPECIFICATIONS: All specifications and/or descriptions of Products and Services as specified in the Order;

SELLER: THEOTOP SRL company, with headquarters in Bucharest, District 3, 32 Vlad Judetu, Register Number J40/4943/1991, CUI RO391391;

2.1. Seller is not responsible for the content, quality or nature of sites which are accessible via links from this site (links to commercial or advertising). The responsibility for these sites a gate entirely owners. Site content (texts, product descriptions, technical specifications, images, symbols) was made in close consultation with representatives FAYNOT. For this reason, the seller does not assume responsibility for product descriptions listed in our store, they are identical to those made available to us by the manufacturer. The images are displayed on site demonstration purposes and actual products delivered may differ from the images in any way (color, accessories, appearance etc.).

2.2. The Seller assumes no responsibility and can not be held responsible for damages incurred by use in any product purchased through section PRODUCTS. The Seller does not give any warranty regarding the proper functioning of the website, information, content, materials or products on the site and its suitability for a particular purpose. Visitors and Buyers expressly agree that use of this site and purchase products at your own risk. The Seller does not warrant that this website, its servers or e-mails sent from the address produse@theotop.ro are free of viruses or other harmful components.

All content of this site www.theotop.ro is the property THEOTOP SRL and its suppliers and is protected by copyright protection law. Seller without the use of any items listed above be punished according to laws.

The seller does not guarantee that the products purchased will look identical to the description of the picture on the website and does not guarantee that the technical specifications of the product will not show changes to the specifications provided in the product description pages. Vendor and its suppliers do not assume any liability for typographical errors or display in terms of prices, features, images, etc.
All products sold by the Seller benefit from the warranty conditions consistent legislation and manufacturer's trade policies. The products are new, in original packaging.

Regular delivery of products purchased from the online store is between 1 day and 35 days from the time of registration command in the server where the website is hosted. In special circumstances the seller reserves the right to increase delivery time.
Delivery can be made by the Purchaser, but transport costs for products ordered is fully borne by the Buyer.

6.1. Prices shown are expressed in Euro's (EUR) with VAT. Printed on the invoice purchase price will be expressed in RON, at the exchange rate from BNR + 1% of the day of payment. There is no minimum order limit price.

6.2. In case the price of the product or some characteristics of the product have been wrongly entered in our database, or displayed wrong and the delivery was not made yet, the Seller reserves the right to cancel delivery of the product and to announce as soon Buyer while about the error.

6.3. In case of any orders with a ridiculously low price, the seller has the right to cancel Buyer's order.

6.4. For large orders, we request an advance of 30%.

6.5. Discounts, specials and promotions are not cumulative. Discount (by volume) in quantities of more than 100 pieces is 5% of the final price.

Whatever the mode of transmission of the order (on site, by phone at headquarters) acceptance of this command, so will the conclusion of the contract and the sale is made by the client when signing the invoice accompanying the product.
The invoice substitutes the contract of sale. When ordering, automatic e-mail that is sent after receipt of order and telephone conversations, e-mail and other methods, staff THEOTOP SRL does not constitute acceptance of the order and therefore no firm conclusion of the contract means.

8.1. Any unauthorized attempt to access the site www.theotop.ro and any attempt at fraud will be reported to authorities.

8.2. Any conflict between Seller and Buyer is trying to be amicably resolved by agreement between the two sides. Where this is not possible Romanian legal provisions shall apply in this area, and conflict resolution is the Romanian courts.

8.3. THEOTOP SRL reserves the right to refuse collaboration with clients exhibiting inappropriate behavior and language (aggressive, licentious etc.) or who have refused delivery order history.

8.4. Being agree to these Terms and Conditions, the Buyer assumes all such risks.

Neither party will be liable for failure to perform its contractual obligations, if such default is due to an event of force majeure. Force majeure is unforeseeable, beyond the parties and cannot be avoided.

By registering on the site or placing an order to www.theotop.ro, I expressly declare agreement to receive commercial communications in the form of newsletters and/or news through any means of communication, from the seller.

This website uses security measures against the loss, misuse or alteration of information that are under our control.
THEOTOP SRL do not assume any liability for losses caused by information bugs or errors in software that is designed and hosted the site. Also not responsible for security errors that may exist in servers hosting company that hosts the site.
